TERMS AND CONDITIONS OF ENTRY TO SPORTS TIPPER 2010 FOOTBALL WORLD CUP WEBSITE TIPPING COMPETITION

A. If you choose to enter the Sports Tipper 2010 Football World Cup Website Tipping Competition, you agree to the following Terms and Conditions entirely and without exception. Entries not complying with these Terms and Conditions of Entry are ineligible and the Administrator reserves the absolute right to disqualify any such Participant from the Competition.

Only those with the ability to freely access the www.sportstipper.com.au Internet website are eligible to participate.

NOTE: TIP SELECTIONS MADE BY ANY OTHER MEANS WILL NOT BE ACCEPTED UNDER ANY CIRCUMSTANCES.

B. The Sports Tipper website tipping competition is run strictly in accordance with the requirement set out for Tipping Competition by the NSW Department of Gaming and Racing.  It is currently conducted as a NON-FOR-PROFIT website tipping competition and run purely as a form of social entertainment, where all money invested by participants (less any costs and expenses properly incurred in connection with the website hosting and purchases of gift prizes - for example the purchase of the Replica FIFA World Cup Trophy in Presentation Box as part of the first prize) - MUST and WILL BE applied towards ALL NOMINATED MONETARY PRIZES as per item 8 below.     

C. Membership is open to fans of all ages. You can join the Sports Tipper website tipping competition as many times as you like, up until the beginning of Match 49.  If you join after the commencement of the competition, your starting rank will be in the middle of the Members Rankings table. If you are under 18 years of age, you will require the consent of a parent or guardian.

D. Unlike other tipping competitions, the Sports Tipper website tipping competition has a unique function which allows all Tipsters the possibility to view all registered members entered tips by clicking on to the ALL TIPS link/icon after the deadline for submitting tips for the current Rounds.  This function eliminating any possible tampering with selections.

E. In these Terms & Conditions of Entry, unless words to the contrary appear, the following words and phrases have the meaning set out next to them:

Match means a single game of and conducted by FIFA, between the 32 qualified National Teams.

Round means a Round of Matches played between any of the 32 qualified National Teams, with each Round divided into Group Stages; Round of 16; Quarter-finals; Semi-finals and Final as per the official FIFA website.  

Competition means the Sports Tipper 2010 Football World Cup website on-line tipping competition that is operated via the www.sportstipper.com.au website.

Results are the results of Matches played as identified by a “2” (Away Team Win - teams that appear to the left-hand side of the Tips Page), an “X” (Draw) or a “1” (Home Team Win -  teams that appear to the right-hand side of the Tips Page). The outcome of these results per match are officially determined in accordance with the rules set out by FIFA at the conclusion of the normal time (90 minutes of play plus any injury time).  Therefore, results are not based on the final outcome of matches that are determined by penalty shoot-outs.

Score means the allocation of points to a Tipster for the correct selection of Match Results and Pick the Score

Pick the Score worth THREE (3) bonus points by forecasting the correct final score at the conclusion of the normal time (90 minutes of play plus any injury time) of the nominated Game of the Round.

Game of the Round the single Match nominated by the Sports Tipper Administrator out of the Round Matches where Tipsters are able to earn Three (3) bonus points by selecting the correct goals scored in the nominated Match between two of the 32 qualified National teams at the conclusion of normal time (90 minutes of play plus any injury time).

Tournament means the duration of the 2010 Football World Cup competition between the 32 qualified National Teams.

Participant means a person who is eligible to participate in the Competition.

Tipster means a registered person who has paid the required joining fee and agrees to the Terms and Conditions of the Sports Tipper website tipping competition entirely and without exception.

Forum the discussion section of the Website where Members can login and have their say about the World Game or any other topic relating to local and international football.

Website means the Sports Tipper Pty Limited 2010 Football World Cup website tipping competition accessible via www.sportstipper.com.au only on the Internet via the World Wide Web.

Administrator/Promoter means the person who manages and directs the running of the Sports Tipper website tipping competition.

1. WHO MAY ENTER

This promotion commences on the 11th June 2010, and after 64 Matches, concludes on the 11th July 2010.

Due to the nature of prizes awarded and Licensing requirements for “Tipping Competition” by the Department of Gaming and Racing, this promotion is only open to residents of Australia where the law in their State allows them to enter promotions of this nature and provided they make payment in Australian Dollars ($AU) by the appropriate means.

2. ENTRANTS BOUND BY CONDITIONS

By participating, entrants agree to be bound by these conditions.

3. OWNERSHIP OF ENTRIES

All entries become and remain the property of the Promoter.

4. METHOD OF ENTRY

To enter the Competition, a Participant must:

a) Register as a Tipster via the BECOME A MEMBER on-line registration form located on the Website by clicking on to the JOIN NOW link/icon in the menu section of the website. Participants must register their own personal details IN FULL to become a Member and participate in the tipping competition. Tipsters must register under their real names in their Tipster Profile and not use nicknames or aliases that differ from their real name.  Incorrect information will result in that Tipster NOT RECEIVING a nominated prize should they win at the end of the competition.

 

b) Be able to produce sufficient identification to prove that the name entered into the Competition Matches their identification, if requested by the Administrator.

 

c) Read these conditions and agree to be bound by these terms and conditions.

 

d) Select a valid “username” (which is the name that appears in the Rankings Table) and “password” at the time of registration. They may choose any username they wish to play in the competition that cannot be modified during the competition.  Participants must keep a record of their "usernames" and "passwords" and remember to enter them each time they wish to access their personal "Tipping Page" of the website.

 

e) Pay a joining fee of $50 when registering as a single Gold Member.  All joining fees are to be made payable to "Sports Tipper Pty Limited" by either cheque, money order or Direct payment by card via the Internet.  PLEASE NOTE: Payment instructions will be noted in the automated "Welcome to the Competition" email received by each joining member once they submit their entry details in the "JOIN NOW link/icon.  This fee is inclusive of GST.

 

The Joining Fee covers both the:

 

a)   access to the Sports Tippers 2010 Football World Cup website tipping competition, with a chance to win the nominated prizes, as per item 8 below, and

 

b)   all expenses and costs properly incurred in connection with the purchase of gift prizes and website running costs - ($5 per Registered Tipster based on 100 joining members, with this amount decreasing with each additional member that joins over the 100th registered member) during the 64 Matches of the competition. 

    

NOTE: PAYMENT MUST BE MADE PRIOR TO THE 11TH JUNE 2010 OR MEMBERSHIP WILL BE SUSPENDED UNTIL PAYMENT IS RECEIVED.

IF A TIPPSTER WINS ANY OF THE PRIZES NOMINATED AND FOR WHATEVER REASON HAS NOT PAID THE REQUIRED REGISTRATION FEE, THEN THAT TIPSTER WILL NOT BE ELIGEBLE TO PICK UP THE WINNINGS.  IN THE UNLIKELY EVENT OF THIS OCCURRING, THE NOMINATED PRIZE WILL BE GIVEN TO THAT TIPSTER WHO FINISHES DIRECTLY BELOW THE ORIGINAL WINING TIPSTER, PROVIDED HE/SHE HAS PAID THEIR REGISTERATION FEE IN FULL.

PERSPECTIVE PARTICIPANTS CAN EXAMINE THE WEBSITE MEMBERS AREA PRIOR TO REGISTERING BY CLICKING ON THE VISITOR LOGIN BUTTON.

THE ADMINISTRATOR RESERVES THE RIGHT NOT TO ACCEPT FOR REGISTRATION ANY PARTICIPANT IF THE REGISTRATION CONTAINS ANYTHING SLANDEROUS OR DEFAMATORY.

ALL MEMBERS CAN JOIN THE COMPETITION AS MANY TIMES AS THEY LIKE, PROVIDED THEY FOLLOW ALL THE REQUIREMENTS OF CONDITION 4 ABOVE.

5. JOINING AFTER COMMENCEMENT OF COMPETITION

Participants may join the competition at any time after its commencement, up until the deadline for submitting tips selections for the Round of 16 Matches, by paying the full amount of the registration-joining fee as per Condition 4 above with-in 7 days from joining. They will begin with a Ranking equivalent to the median ranking of all the registered members. That is, they will begin in the middle of the
Members Rankings table. Their Total Score will consist of the following points: one (1) point for their Away "2" selections column and one (1) point for their Draw "X" selections column, zero (0) points for their "Pick the Score" (PS) selections column and the remaining points of their total score will appear on their Home "1" selections column.

 

6. GOLD AND BRONZE MEMBERSHIPS

 

a) Gold Member/Tipster a person who joins the Sports Tipper Website Tipping Competition by paying $50 - allowing him/her a chance to win ALL of the nominated competition prizes (refer to Term 8 below).

 

c) Bronze Member a person who joins the Sports Tipper Website Tipping Competition for free and is only allowed to participate in the Forum but not in the Tipping Competition.

7. HOW TO PLAY

a) Tipsters are required to access the
www.sportstipper.com.au website and make their selections before the commencement of for each Round by the AEST (Australian Eastern Standard Time). The date and time of each deadline is shown next to each Round in the Tipsters` Tips page. It is solely the responsibility of each Tipster to ensure that their tips are entered correctly - (check time and date your last tips were entered on the Tips page and that your tips are displayed correctly in the drop-down boxes after you submit them by clicking onto the Submit bottom, causing the screen to reload, i.e. disappear then reappear).

b) Tipsters may change their selections, even after they have clicked the "Submit" button, provided they do so prior to the nominated Deadline for submitting tips in each Round of matches. The Website will close all Games at the nominated deadline date and time for each round. Submissions after this deadline will not be accepted under any circumstances.

c) The changing of fixture dates and/or venue times due to bad weather conditions or other cup commitments, etc of matches is not controlled by the Administrators of the Sports Tipper website tipping competition. Each player must therefore endeavour to keep in touch with the programming of the Matches as the World Cup tournament progresses. Tipping prior to nominated cut-off time is the responsibility of each Tipster.  PLEASE NOTE: Reminder Emails will be sent out to all registered Members prior to kick-off for each Round of matches.

d) If a Tipster is planning to go on holidays for any period of time during the Competition, it is his/her responsibility to submit their selections during their holiday period.

e) Tipsters can submit their tipping selections three (3) Rounds in advance if so desired, to avoid submitting their tips selections per Round.


f) Tipsters selections to all Round Matchse will be available for viewing on the Website, by clicking on to the ALL TIPS link/icon, after the closure of each Round, usually after the 11:59pm deadline prior to the first Match/Matches being played from each Round.

h) If a Tipster does not submit an entry for any given Match or Matches, then that Tipster will automatically receive zero (0) points for that Match or Matches.

i) If a Tipster does not submit a "Pick the Score" in a Round, then they will automatically receive zero (0) points for his/hers "Pick the Score" in that Round.

j) In the event of a Match being cancelled, abandoned, not completed or not played for any reason and/or FIFA does not officially declare a result within the 64 matches of the competition, it is treated as a no-win for both teams competing in that Match and all Tipsters will receive zero (0) points for that Match.

8. PRIZES

Based on the $50 joining fee per registered player and the fact that the competition is conducted as a NON-FOR-PROFIT website tipping competition, $5 from each joining fee will go towards the proper website running costs and costs associated with the purchases of gift prizes as mentioned above in paragraph B. The remaining $45 per registered player will be distributed in monetary prizes at the conclusion of Match 64 ( THE FINAL) as follows:

 

- 1st Ranked Tipster to receive 70% of total amount collected including a limited edition FIFA World Cup Trophy in Presentation Box featuring tribute booklet valued at $399.00.

 

PLEASE NOTE: Due to the competition being conducted as a NON-FOR-PROFIT tipping competition, the Replica FIFA Trophy prize mentioned as part of the first prize above, will only be awarded if a minimum of about 100 Gold Members join the competition.  If less than 100 Gold Members join the competition, ALL MONIES received from joining fees ($50) will ALL go towards the top three monatary prizes. So let your family, friends and workmates know about  this great competition via our "Tell a Friend" link/icon.

- 2nd Ranked Tipster to receive 20% of total amount collected;

 

- 3rd Ranked Tipster to receive 10% of total amount collected;

 

9. SCORING

a) Each Round consists of a group of Matches between 32 qualified National Teams - with one (1) point allocated to each Tipster who manages to forecast the correct outcome out of three possible Results per Match. For each Match Tipsters can choose either a home win, (selecting the team on the left-side of the tips page to win by clicking on to "1" in the drop-down boxes), an away win, (selecting the team on the right-side of the tips page to win by clicking on to "2" in the drop-down boxes ), or a draw between both teams, (by selecting "X" in the drop-down boxes ). Zero (0) points will be allocated for each incorrect tip / tips. 

b) In addition to this, each Tipster can score an additional THREE (3) bonus points for selecting the correct final Score at the conclusion of the normal time (90 minutes of play plus any injury time) for the "Game of the Round" which will be nominated by the Administrator. The correct outcome for that game (1, X or 2) is picked automatically depending on the Tipsters final score selections at the conclusion of the normal time (90 minutes of play plus any injury time).
 

For example, if the nominated "Game of the Round" was Germany vs Australia with Germany being the home team and the final Score was 2-1 in favour of Germany, then a Tipster will only receive the four (4) maximum points for that game if he/she manages to pick the correct final score for that Match.  In other words, a Tipster will receive the (3) bonus points for picking 2-1 for the correct final Score in the drop-down box provided next to the nominated "Game of the Round", with one (1) point automatically received for selecting the home team to win. 
Tipsters can still receive one (1) point for the "Game of the Round" and not the three (3) bonus points, provided they pick the home team to win by more goals than the away team in the drop-down box.

c) At the end of the competition, the Tipster who manages to accumulate the highest Score after sixty-four (64) Matches, will be regarded as the 1st Ranked Tipster and will win the nominated 1st prize. (Refer to item 8 above).

d) If more than one Tipster finishes the Season with the same highest score, then the 1st prize money will be distributed as follows:
The Tipster with the most away wins in their total Score will take the prize money allocated.
If the Results are still equal, then the Tipster with the most draws in their total Score will take the prize money allocated.
If the Results are still equal, then the Tipster with the most picks for the Pick the Score will take the prize money allocated.
If the Scores are still equal - (which means that those top ranked Tipsters all finish the season with the same away wins, draws, home wins and picks for the nominated Games of the Round) - then the nominated prize monies (based on the number of Tipsters who finish the competition with the identical Scores) will be added together and divided equally to all those Tipsters. 

 

For example:

 

1. If two Tipsters receive identical Scores at the conclusion of match 64, then the 1st and 2nd nominated price monies will be added together and divided equally between those two Tipsters. 

 

2. If three or more Tipsters receive identical Scores at the conclusion of match 64, then the 1st, 2nd and 3rd nominated price monies will be added together and divided equally between those Tipsters. 

e) If a winning Tipster is unable to accept a prize for whatever reason, the Administrator will award that prize to the Tipster or Tipsters who would have met the entry eligibility criteria and been deemed the place winner or winners had the winning Tipsters not participated in the Competition.

10. DURATION OF THE PROMOTION

The promotion commences on the 11th June 2010 and concludes on 11th July 2010.

11. THE NATURE AND VALUE OF THE PRIZES

The Sports Tipper website tipping competition offers approximately $ (amount will be based on total number of joining Members) in prize monies by the end of the competition. This amount may vary depending on the number of Tipsters that register into the competition up until the deadline for submitting Tips for the Round of 16 Matches.

12. PLACE, DATE & TIME OF WINNERS ANNOUNCEMENT

All winners will be notified by email, using the registration details provided in their
Your Details page, with their names also published in the News Update section on the Home page of the www.sportstipper.com.au website within 24 hours of them winning a nominated prize. All previous Rounds` tips are also available on the Website in the Your Tips and All Tips page in the Website members area.

13. METHOD OF ADVISING RESULTS

All Results will be made available for all Tipsters to view in the News Update and Members Ranking pages of the
www.sportstipper.com.au website within 24 hours after the conclusion of each Round. All previous Rounds` Results are also available on the Website in the Your Tips and All Tips page in the Website members area.

14. ADMINISTRATORS / PROMOTORS RIGHTS

If for any reason this competition is not capable of running as planned, infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to the extent permitted by law to not only disqualify any individual who tampers with the entry process, but subject to the nature and size of the disruption, to cancel, terminate, modify or suspend the competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any personal injury suffered or sustained, or damage to participant’s or any other person’s computer related to or resulting from participation or downloading any materials in this competition.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR THE INFORMATION ON A WEBSITE, OR TO OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THIS COMPETITION, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WHETHER SUCCESSFUL OR NOT, THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.

Information about Tipsters is used by the Administrator to assess and process registration in the Competition. If an applicant does not provide the required information, the Administrator cannot process the registration. All entries become the property of the Administrator and will be entered into a database. The Administrators use information emanating from the Tipster’s participation in the Competition for the determination of winners and distribution of prizes, if any, awarded to a Tipster. Tipsters consent to publishing their Real Name or Username and accumulated winning team points in the members’ section of the Website. They may elect to show their real name in the Tipster Profile screen. The Administrator will not be held responsible for any loss of reputation, status or otherwise in connection with a Tipster’s tipping selections and consequential Results. It is a condition of entry that Tipsters consent to these uses and disclosures of their information. Information about Tipsters may also be used by the Administrators for the purposes of carrying out marketing, planning, product development and direct mail and promotional campaigns unless a Tipster otherwise withdraws their consent to the use of their information in this manner.

Notwithstanding it is the Administrator’s right to not accept or to subsequently disqualify a Tipster, and the Administrators will not be liable for any legal action arising out of any name being slanderous or defamatory to the public at large or any similarly sounding. Any Tipster who uses a name, which is subsequently found to be slanderous or defamatory in any way, will indemnify the Administrators from any legal action, claim or dispute arising in relation thereto.

In the event there is a dispute concerning the conduct of the Administrators, the decision of the Administrator is final and no correspondence will be entered into. The Administrators shall not be liable for any loss, damage or personal injury whatsoever which is suffered or sustained (including but not limited to indirect or consequential loss) as a result of taking a prize, except for any liability, which cannot be excluded by law. Prizes are not transferable.

The winner agrees to participate in any news media activities surrounding the promotion.

Sports Tippers’ Administrator collects your information to include you in this Competition and will disclose the information to others who help us run the Competition. We may also use the information to assist us in improving our goods and services and to contact you in the future in regard to our other goods and services. We may share your information with other persons or entities that assist us in performing the above or with another company, which provides prizes for the Competition or reader offer.
